  • A decorator was left alone under his contract  by the claimant
  • The decorator went out to fetch some wallpaper, leaving the door unlocked
  • While he was out, thieves stole property from the claimant’s house


  • Did Troman owe a duty in tort under his contract to decorate


  • Duty found, recovery allowed


  •  The contractual relationship created a duty which was then breached by not securing the property. The theft occurred as a result of this breach
