Royal Trust of Canada v Markham [1975]

This case found that evidence would be required to to determine whether a mortgagor would be able to repay mortgage arrears within a reasonable period of time. Such evidence would be required before possession by a mortgagee could be postponed under section 36 of the Administration of Justice Act 1970.
