Honeywell [2010, German Constitutional Court]

This case illustrates Germany’s dissatisfaction (or constitutional tolerance) of EU law’s supremacy. The Court of Justice agreed with the Commission that the merger between two companies: General Electric and Honeywell (avionics) would have breached competition law. The German Constitutional Court disagreed with this decision, but found it not to be ‘sufficiently’ serious to disregard it.
