  • The defendant broke into the house of an 87-year-old man, when the man was present
  • The man had a heart attack and died


  • Was the defendant guilty of unlawful act manslaughter?


  • No


  • On the facts, it could not be proved that the heart attack was caused by the defendant
  • In principle, the act itself was dangerous and the frailty of the man would have been obvious
