R v Secretary of State for the Environment, ex p Kirkstall Valley Campaign Ltd [1996]


  • The Leeds Development Organisation had the power to grant planing permission to land owners to assist with the development of Leeds as a city
  • Planning permission was granted to a rugby club in Leeds, which was likely to be ultimately of financial benefit to the chairman of the Leeds Development Organisation


  • Was there bias in the decision, was the quango amenable to judicial review


  • No bias, but quangos are amenable to judicial review


  • The judgment was very critical of the chairman
  • More importantly, the courts now have control of quangos
