R v Jheeta [2007]


  • The defendant husband sent text messages to the victim, pretending that they were from the police, threatening that her husband would likely commit suicide if she failed to have sexual intercourse with him


  • Did the victim consent to the intercourse, or was there deception as to the nature/purpose of the act?


  • Consent was secure, conviction quashed


  • The text messages were deceptive, but the act itself was consented to
