  • He claimed that evidence found in a search of his house should be excluded as a magistrate had not been rigorous enough in granting a search warrant

  • Search warrants issued under s 8 PACE must comply with PACE; a magistrate may not issue a warrant with is both for ‘specific premises’ and ‘all premises’
