Hypo-Mortgage Services v Robinson [1997]

Children may not claim that they have an overriding interest in land by virtue of their actual occupation under the Land Registration Act 1925, section 70(1)(g), as they live in the shadow of their parents.

This case equally applies to the replacement Land Registration Act 2002, Schedule 3, paragraph 2.
