DPP v Meaden [2004]

Facts

  • The police, in executing a warrant, searched one room of the named property and found it ‘clean’. They then put all of the occupants in this room and proceeded to search the rest of the property.
  • Meaden attempted to escape the clean room.

  • Did Meaden assault an officer in the execution of is duty in trying to escape; was he lawfully detained?
