Dodsworth v Dodsworth (1973)


  • The owner of a house allowed her brother and sister-in-law to live with her for ‘as long as they wished’
  • In reliance on this, the couple spent £700 improving the property


  • Could the owner be estopped from denying the couple’s right to indefinite occupation?


  • Yes


  • Although awarding the equivalent of their expectation would not be equitable, they were entitled to the return of £700
