Desmond v Chief Constable of Nottinghamshire Police [2011]


  • On request the police supplied the claimant with a copy of their criminal record, however it included details of an assault which had been proved not the fault of the claimant


  • Did the claimant owe a duty of care in providing the record


  • No duty


  • A duty would conflict with the statutory duty to protect vulnerable people, therefore a duty was not found.
