Chevassus-Marche v Groupe Danone [2008, ECJ]

Regulation 7(2) of the Commercial Agents (Council Directive) Regulations 1993 will not apply where the agent or principal is not involved either directly or indirectly in the conclusion of the contract which gives rise to commission. The purchase in question had circumvented both the principal and agent, although it was within the exclusive geographic jurisdiction of the agent.
