Case C-410/92 Johnson 
The facts of this case were very similar to Emmott , concerning the same directive. The case doubted Emmott , finding that it would limited to its own exceptional facts (where the principle of equal treatment was violated), and the estoppel exception to the principle of effectiveness has now been effectively eradicated.
