Case C-326/96 Levez [1998]

The Court of Justice found that in examining whether a Member State had complied with the principle of equivalence, consideration should be given to the purpose and characteristics of similar national actions. The remedy for breaches of EU law must not be less favourable to a claimant than it would be for a breach of national law.
