Case 70/77 Simmenthal [1978]

This case required the abolition of a meat import levy imposed in Italy, supposedly for inspection purposes. It was in violation of EU law, which prohibited such taxes, and EU law, by virtue of Costa v ENEL [1964], is to be held as supreme over conflicting national law.

The case also explained that Art 277 TFEU on making illegality claims alongside other claims for judicial review is to be used to challenge the validity of acts previous to an act being challenged with standing in current proceedings for purpose of annulling the later act in question.
