Case 104/79 Foglia v Novello I 
The case found that the Court of Justice has no jurisdiction to answer non-genuine preliminary reference questions. The reference in question had been induced to obtain a decision on a question of tax law by two Italian nationals, who inserted a relevant term into a contract between them.
