Bristol & West Building Society v Ellis [1996]

During proceedings for postponement of possession by a mortgagor under section 36 of the Administration of Justice Act 1970, postponement for 3 to 5 years to allow the mortgagor to sell her property (after her husband left) was refused on the basis of a lack of evidence that the sale value would cover the outstanding mortgage loan amount.
