- The claimants submitted a tender for a pleasure flights contract
- The defendants believed, erroneously, that the tender had arrived later, so did not qualify
- Was there an obligation to consider all conforming tenders
- Although there was no obligation to accept a specific tender, unless otherwise specified, a call for tenders does create a collateral contract for the caller to consider all conforming tenders
