Case T-38/98 Associazione Nazionale Bieticoltori v Council [1998]
An association may lodge a claim for judicial review. It will be individually concerned with an act under the Plaumann test if:
- The act is directly addressed to trade associations;
- The association represents the interests of persons who would be individually concerned; OR
- The association itself, because of its own interests, is individually concerned with the act
None of these (mutually exclusive) conditions were satisfied by ANB; it was not individually concerned with an act abolishing all aid given to sugar beet producers.
